Terms of Service

These Terms of Service (these "Terms") constitute a binding agreement between Cashout Mobile LLC, an Ohio limited liability company ("Cashout," "we," "us"), and each individual or entity that accesses or uses the Cashout iOS application, the Cashout merchant web portal, or the website at cashoutmobile.com (collectively, the "Service"). By accessing or using the Service, you accept these Terms. Business accounts are additionally governed by the Merchant Services Agreement.
1. The Service
The Service presents short-form video content from participating businesses to verified student users. Viewing such content accrues "Dough," an in-application reward instrument, which student users may exchange for promotional offers ("Coupons") redeemable with participating businesses in person or online. Participating businesses receive verified, aggregated performance metrics.
2. Eligibility; Accounts
Student accounts are available only to individuals who are at least eighteen (18) years of age and enrolled at a supported institution, as verified by school email address. Business accounts may be created only by an individual authorized to act on behalf of the business. Each individual may maintain only one account. Personnel scanning accounts are provisioned exclusively through a business's join code. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
3. Dough
DOUGH IS A PROMOTIONAL REWARD INSTRUMENT ONLY. IT HAS NO MONETARY VALUE, IS NOT LEGAL TENDER, STORED VALUE, OR A DEPOSIT, IS NOT REDEEMABLE FOR CASH, AND MAY NOT BE TRANSFERRED, SOLD, OR EXCHANGED OUTSIDE THE SERVICE. Cashout may modify earning rates, inactivity decay, and Coupon pricing prospectively at any time, and may adjust or revoke balances accrued through fraud, abuse, or error. Dough constitutes a limited, revocable license and not property.
4. Coupons and Redemptions
A Coupon acquired by a student user is valid until its stated expiration and is redeemable once. Participating businesses are obligated to honor valid, unexpired Coupons; if a business refuses a valid Coupon, the user may report the refusal within the application and Cashout will restore the associated Dough. Expired Coupons are neither redeemable nor refundable. Redemptions are verified server-side; attempts to redeem a Coupon not acquired by the presenting user, or previously redeemed, will be rejected. COUPON OFFERS ARE MADE BY THE PARTICIPATING BUSINESSES AND NOT BY CASHOUT; CASHOUT IS NOT A PARTY TO, AND DISCLAIMS LIABILITY ARISING FROM, THE UNDERLYING SALE OF GOODS OR SERVICES.
5. Prohibited Conduct
You shall not: (a) generate fabricated or automated views, self-dealing scans, or manipulated redemptions; (b) maintain multiple accounts; (c) attempt to identify other users or re-identify pseudonymized data; (d) scrape, harvest, or systematically extract data from the Service; (e) probe, disable, or circumvent security or verification mechanisms; or (f) use the Service in violation of applicable law. Cashout may suspend or terminate accounts engaged in prohibited conduct and may cancel associated Dough and Coupons.
6. Content; Intellectual Property
Participating businesses retain ownership of the content they upload and are solely responsible for its accuracy and lawfulness. By posting content, a business grants Cashout a license to display it within the Service. Cashout may remove content that is unlawful, misleading, or in violation of these Terms. The Service, including its software, design, and methodologies, is the property of Cashout and its licensors, and no rights are granted except as expressly stated in these Terms.
7. Business Accounts
Business functionality — including billing, offer publication, personnel scanning, and analytics — is governed by the Merchant Services Agreement accepted at business onboarding. In the event of a conflict between these Terms and the Merchant Services Agreement with respect to a business account, the Merchant Services Agreement controls.
8. Termination
You may discontinue use of the Service and delete your account at any time within the application. Cashout may suspend or terminate any account for violation of these Terms, effective immediately upon notice. Provisions that by their nature should survive termination — including Sections 3 (Dough), 9 (Disclaimers; Limitation of Liability), and 10 (Governing Law) — survive.
9. Disclaimers; Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CASHOUT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, AND CASHOUT'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS (US $100) OR THE AMOUNTS YOU PAID TO CASHOUT IN THE THREE (3) MONTHS PRECEDING THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, IN WHICH CASE THESE LIMITATIONS APPLY TO THE MAXIMUM EXTENT PERMITTED.
10. Governing Law; Venue
These Terms are governed by the laws of the State of Ohio, USA, without regard to conflict-of-laws principles. The state and federal courts located in Ohio have exclusive jurisdiction and venue over any dispute arising out of or relating to these Terms or the Service.
11. Modifications
Cashout may amend these Terms prospectively. Material changes will be announced within the application or by email at least fourteen (14) days before their effective date. Continued use of the Service after the effective date constitutes acceptance of the amended Terms.
